Welcome to Lively! These terms and conditions ("Terms") govern your access to and use of the Lively mobile application ("App") and any related services provided by Lively.

1. Acceptance of Terms

By accessing or using the Lively App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not access or use the Lively App.

2. App Overview

The Lively App provides a personal approach to the global issue of digital overload. A habit tracker with a suite of tips, tools, techniques, challenges and content promote a healthier relationship with technology, making you less distracted and more productive in everything you do – not just work! LiVELY syncs your unique goals with a daily planner packed with healthy digital habits for your practice. On the way you’ll keep track of your stats, celebrate streaks and receive awards. There’s access to a rich content library of helpful, entertaining blogs, videos, podcasts and more. The App is owned and operated by The Trustee for LiVELY Trust ("we", "us", "our").

3. Account Registration

a. Account Creation: You may need to create an account to access certain features of the Lively App. When creating an account, you must provide accurate and complete information.

b. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorised access to your account.

4. App Usage

a. License: We grant you a personal, non-exclusive, non-transferable, revocable license to use the Lively App solely for your personal, non-commercial use in accordance with these Terms.

b. Restrictions: You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Lively App. You also agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on the App.

5. User Content

a. User Content: The Lively App may allow you to submit or upload content, such as photos, videos, or comments. You retain ownership of any intellectual property rights that you hold in that content.

b. License to User Content: By submitting or uploading content to the Lively App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Lively App and our business operations.

6. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose your information when you use the Lively App. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

7. Prohibited Conduct

When using the Lively App, you agree not to:

The Lively App is provided on an "as-is" and "as available" basis without warranties of any kind. We do not warrant that the Lively App will be uninterrupted or error-free, nor do we make any warranties regarding the accuracy, reliability, or currency of any information provided through the App.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your access to or use of the Lively App.

11. Governing Law

These Terms are governed by and construed in accordance with the law, without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms within the Lively App, and the "Last Updated" date will indicate when the changes become effective. Your continued use of the Lively App after the changes become effective constitutes your acceptance of the revised Terms.
